17. Rule 6.4.7(1) requires the applicant to directly state if surface water or groundwater will be affected <br />by the mining operation. The applicant did not locate any wells within 600 feet of the affected land. <br />Pelino, Inc. will need to identify all wells of the surrounding azea to determine if any may be <br />impacted by the mining operation. In accordance with Rule 6.4.7(2)(a), please identify all of these <br />wells on the exhibit(s). <br />I8. Please state the overall depth to groundwater within the affected azea of the mining operation. <br />19. In accordance with Rule 6.4.7(2)(b), the Division requests that the applicant identify and characterize <br />the aquifer to be mined in or through. The Division also requests that the applicant define or predict <br />the cone of depression expected for any areas to be dewatered and dry mined during the life of the <br />operation. The cone of depression assessment should define, at a minimum, the horizontal and <br />vertical extent of drawdown expected. If during the assessment, the applicant determines that a <br />drawdown will occur offsite that may impact a cun•ent groundwater user, the applicant should explain <br />any mitigation measures to be implemented and trigger points that would put mitigation measures <br />into effect. <br />20. In accordance with Rule 3.1.6(1)(a), please explain how disturbance to the hydrologic balance will be <br />minimized during the mining and reclamation phase of the Jesse Lee Pit. Please explain how Pelino, <br />Inc. will be in compliance with Colorado Water Laws and regulations governing injury to existing <br />water rights. Please inform the Division as to when a Temporary Substitute Supply Plan, Well Permit <br />and Plan of Augmentation will be obtained from the Division of Water Resources. The Division <br />received comments from the Office of the State Engineer (OSE) regarding the application. The letter <br />is enclosed for reference. Please aclmowledge the conditions for approval noted by the OSE. Once <br />the well permit is obtained a copy must be submitted to the Division. <br />21. Please explain how water from dewatering of the Jesse Lee Pit will be managed to protect against <br />pollution of surface of groundwater both during and after the mining operation (Rule 6.4.7(2)(c)). <br />Rule 6.4.10 Exhibit J-Vegetation Information <br />22. Please state if wetlands aze present on site and provide addifional information regazding reclamation <br />of wetland areas. In particulaz, please state the final reclaimed slopes, depth of topsoil to be replaced <br />and the seed mixture to be utilized, <br />Rule 6.4.12 Exhibit L- Reclamation Costs <br />23. The Division will estimate a cost to reclaim the site based on the information submitted in the <br />application. <br />Rule 6.4.13 Exhibit M-Other Permits and Licenses <br />24. As previously noted, a National Pollutant Discharge Elimination System (NPDES) permit may be <br />required by the Colorado Department of Public Health and the Environment. You should contact that <br />agency regarding the need for a permit. <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />Z5. Please be aware if the applicant encroaches into any easements as a result of the mining and operation <br />plan, then the applicant must obtain legal right of entry document from the easement holder. Please <br />state what easements will be included, and provide legal right of entry agreements. <br />26. Enclosed, please find a letter from the Colorado Historical Society (CHS) regarding the cultural <br />resources survey. <br />
