Rule 6.4.4 Exhibit D-Mining Plan <br />6. Please list and locate on the applicable exhibit all structures that will be constructed on site (i.e. <br />plants, offices, trailers, tanks, etc...) and provide their associated dimensions and composition in <br />order to accurately estimate a cost for removal in the reclamation bond estimate. <br />7. The operator notes that the diversion ditch will expose groundwater and carry water into the existing <br />sediment ponds. Please state the total depth of the pit, and the elevation in which ground water will <br />be exposed. <br />8. Please inform the Division as to how topsoil and overburden piles will be protected to prevent wind <br />and water erosion to include the dimensions of the piles and a temporary seed mixture. If a seed <br />mixture is proposed, please state the rate in PLS/acre, application method and timing of seeding. <br />9. The applicant proposes sediment ponds to be used on site. Please describe in further detail the <br />construction, dimensions, use and management of these ponds. Please explain how water will be <br />routed to the ponds, any discharges features to be installed and explain how the ponds will be <br />reclaimed. Please be aware that if the ponds discharge mine water, a National Pollutant Dischazge <br />Elimination System (NPDES) permit will be required by the Colorado Department of Public Health <br />and the Environment. Please contact that agency regazding the need for a permit. <br />] 0. The mine plan maps notes a diversion ditch that connects to Maxwell Creek and a relocated diversion <br />ditch that connects to the sediment pond. Please describe if the ditch that connects to Maxwell Creek <br />will be used during the mining operation, or if it will be reclaimed. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />11. Please state what surface water rights exist or will be used to divert water into the ponds to achieve <br />the post mining land use. <br />12. Please state and describe the reclamation practices for the diversion ditches. <br />13. There are two existing ponds to remain on site after mining. However, it appears that the pit floor <br />will remain dry and be above the ground water table as part of the post mining land use. Please state <br />the ground water elevafion of these ponds and explain the difference in the pit floor elevations versus <br />the elevation of ground water. If ground water is exposed during mining, the pit must be reclaimed to <br />a minimum of two feet above the seasonal high ground water table elevation, Please clarify this <br />issue with the Division. <br />14. The applicant states that there is no overburden to remove and the type of product has been consistent <br />throughout the approximate 50 foot depth of this pit. If no overburden exists on site, then please <br />explain the source of the material that will be used to backfill the pit in accordance with the proposed <br />reclamation plan. <br />Rule 6.4.7 Exhibit G- Water Information <br />15. Please provide an estimate of the project water requirements including flow rates and annual volumes <br />from the development, mining and reclamation phases of the project as required by Rule 6.4.7(3). In <br />addition, please submit a copy of the source of the water rights obtained by Pelino, Inc. to supply the <br />project water requirements for the mining operation and reclamation. <br />I6. Please specify the maximum acreage ofpit that will be dewatered at any given time during mining <br />and reclamation of the Jesse Lee Pit. <br />
