the one we are now attempting to correct the 3 acres to 9.9 acres. When we <br />talked to Carl Mount on the phone about this problem he stated "The <br />Department Goofed" We are charged an yearly assessment fee for the <br />1992 permit and pay it.... they said they didn't have our address! <br />When Carl Mount and Bruce Humphries were on our property last <br />September Carl used his GPS on our newly installed post to mark the 9.9 <br />acres and he stated that we should move the two on the slope down to make <br />sure we were in our 9.9 acres. To me this means he thought they were <br />correct and we could move on at this point. <br />Discussing the many mistakes we have had with the Dept of Mineral and <br />Geology we asked Bruce Humphries why there were so many, he replied" <br />guess you are just lucky!" <br />I feel that if the Department of Mineral and Geology didn't feel they had <br />made a mistake they wouldn't give us a free amendment! <br />I have enclosed some of their rules and some letters for your information. <br />We only want what we paid for and we don't like the allegations Carl <br />Mount has stated in his letter to you. <br />We do not intend on mining the whole 9.9 acres as we are approaching 70 <br />years of age. What was to be a very exciting time in our lives has had a <br />damper put on it by the Department. <br />I would also like to inform you that the Dept. Of Mineral and Geology sets <br />a price for cleaning up the property if we do damage to it and walk away. <br />The previously miner back several years did just that and it took the Dept. <br />of Mineral and Geology 8 years to clean up our property. They stated to us <br />that they didn't have personal enough to do the job. They do not do the <br />work them selves as they higher outside contractors to do it. Makes you <br />wonder, doesn't it! 8 Years! <br />We as landowners and property tax payers , wonder if maybe our <br />constitutional rights are being violated! <br />If you have any questions regarding this application, please contact me at <br />260-665-7060. <br />
