We were allowed to
wash 70,000 tons ofgravel a year but couldn't get out of the 3 acres. Never
did they state to us that you subtract the pre permit pre-law roads. So all
this time we have been working in 1.3 acres. Not until we discovered last
year that other miners applied before and after we did, received a 9.9 acre
permit for the same amount $875.00.
We had applied for a permit to mine for gold previously in 1987, we
applied for a prospect permit and was told we needed a letter of credit for
$5,000.00. We took out a letter of credit at our bank in Indiana. When
later we inspected the property where we were going to mine, it wasn't on
our property. We notified the Dept. Of Mineral and Geology of our frnding
and to cancel out permit. They never canceled it. After 17 years they went
after our letter of credit of $S, 000.00 and a fine amounting to $3, 000.00
totaling $8, 000.00 At this time, they never checked to see if there was any
land disturbance or mining activity. When we finally contacted them after
our banker notified us that they had tried to get the money. They stated they
tried to contact us but we did not give them our forwarding address.
Well.... they had our address because we had a permit we received in 1992,
