Relocate the existing northwest comer of the <br />completed Howe reservoir to accommodate these relocated features. Install a a- <br />foot drop structures in the Bull Seep Slough and the South Platte River at the <br />confluence of the Slough and the River to raise the invert of the BuII Seep Slough. <br />Improve the Bull Seep Slough to handle a maximum 4800 cfs flow from the <br />Howe reservoir spillway on the Denver/South Adams Hazeltine property. Fill <br />portions of the Bull Seep Slough located on the Denver/South Adams Howe <br />property, as well as the current Bull Seep channel to Ibe relocated. <br />Alternative 3.a (presented at,4ugust 29 meeting) -Tracks much of Altemative 3, <br />but the dischazge from Bull Seep/First Croak to the Bull Seep Slough would be <br />onto McIntosh property, as would the discharge from the Reservoir spillway. <br />Would eliminate the need to relocate the northwest comer of the constructed <br />Howe reservoir. <br />As a threshold matter, the location of the Sull Seep, the handling of First Creek <br />nuisance flaws, and the obligation to install a reservoir spillway to handle First Creek <br />flood flows, aze controlled by a valid mined land reclamation permit issued by the <br />Colorado Mined Lend Reclamation Board to Mobile Premix. The effective Reclamation <br />Plan is the product of an open, public process that concluded in 1990. Mobile Premix is <br />committed to ensuring compliance with the existing Reclamation Plan, or, a reasonable <br />altentative for these features that may result from the present Task Force process. <br />Based on statements contained in an August 24, 2001 letter to UDFCD, Denver <br />Water is not presently prepazed to make commitments relating to the future operation of <br />the three-reservoir complex of which the Howe structure is a part. This is unfortunate <br />since Alternative 2 would essentially locate the First Creek flood flows in much the same <br />manner as they were historically, and spill [hose flows through the reservoir complex to <br />the South Platte River. In addition, Altemative 2 would preclude the implementation of <br />intensive flood control and flow management upgrades in sensitive areas of the Bull Seep <br />Slouglt_ These improvements necessarily implicate the~Hazeltine property mined land <br />permit held by Albert Frci & Sons, Inc. (NLRB Permit No. M-77-153). <br />Since Denver Water and South Adams are unwilling to make the commitments <br />necessary to carry oui Alternative Z (i.e., Mobile Premix's preferred alternative), <br />Alternatives 1, 3 and 3,a come into play. Absent the improvements to the Bull Seep <br />Slough, Alternative 1 reflects, to great extent, the current approved Reclamation Plaa. <br />Altematives 3 and 3.a aze, essentially, modifications of Alternative 1. Where Alternative <br />3 is concerned, Mobile Premix would prefer that the Bull Seep be located as provided in <br />the effective Reclamation Plan. This would preclude the need to engage in time- <br />consuming negotiations to atncnd the currently recorded easement that specifies where <br />the Bull Seep is to be located within a larger conservation easement.
