IF <br />necessary, the Lessee agrees to construct fences or other barriers azound the perimeter of safety-hazard azeas to <br />minimize the potential for intrusion by humans, livestock, and wildlife. Radioactive materials exposed by the <br />Lessee's operation shall be managed to ensure that the exposure of humans and ecosystems is as low as <br />reasonably achievable. <br />XI. ENVIRONMENTAL REOUIREMENTS. The Lessee, at the Lessee's expense, agrees to comply with <br />ail applicable statutes and regulations and to abide by the specific requirements and stipulations se[ forth in <br />Appendix "C", which is attached hereto and hereby made a part hereof. <br />XII. EXPLORATION PLAN. <br />(a) Prior to commencing any surface-disturbing operations to explore, test, or prospect far minerals <br />covered by this lease, the Lessee shall file with the Contracting Officer three (3) copies of a plan for [he <br />proposed exploration activities and shall obtain the Contracting Officer's approval of such plan. The Exploration <br />Plan shall be consistent with the "Notice of Intent to Conduct Prospecting Operations" (hereinafter "Notice") to <br />be filed with the Colorado Mined Land Reclamation Boazd (hereinafter MLRB) in accordance with "Rule 5" of <br />the "Mineral Rules and Regulations" of the Colorado MLRB, as these rules may be amended. The Exploration <br />Plan shall include all information required by the "Notice", and in addition, must specifically include the <br />following information: <br />(1) Asite-specific environmental analysis; <br />(2) A description of specific measures to be taken to assure compliance with the requirements <br />of Article XI "ENVIRONMENTAL REQUIREMENTS", including methods of reclamation <br />contemplated by the Lessee; and <br />(3) The specific information outlined in Appendix "C" of this lease. <br />(b) All Exploration Plans submitted to the Contracting Officer pursuant to this Article XII and all <br />proposed activities contained therein shall be reviewed by DOE in accordance with 10 CFR Part 1021 "National <br />Environmental Policy Act Implementing Procedures". <br /> <br />-5- <br />
