Mr. Gregg Kitchen <br />Seneca Coa] Company <br />Page 2 <br />On page 2 under this section, the final pazagraph references the fact that "...slides at the Seneca <br />II-W `A' Pit highwall and Pond 016A aze adequately addressed in the TR-45". These issues <br />were addressed in the TR-49 submittal, not TR-45. The DMG does have adequacy concerns that <br />were sent out November 16 including questions regazding the SEDCAD documentation. Mike <br />Boulay met with representatives from SCC and Montgomery Watson Harza (MWH) on October <br />19, 2004 to discuss SEDCAD designs and documentations. A recent response to Seneca Il TR- <br />36 shows substantial improvement in the SEDCAD design presentations. <br />Other Compliance Related Projects <br />Seneca II Mine <br />There seems to be confusion regazding the rill and gully erosion at the Seneca II Mine. The <br />DMG has identified two areas neaz the elk fence/shrub establishment area where erosion has <br />been a concem. One area is located to the south and southeast of the shrub plot, and the other <br />area is located above and to the north of the shrub plot. <br />The DMG believes the area of "considerable repairs" that SCC refers to in the November 16, <br />2004 letter is to the south and southeast of the elk fence/shrub establishment area. The DMG <br />agrees with SCC that the gullies on the south-facing slope at the lower end of the former East <br />Wadge Pit and final dozer pit location (south and southeast of the elk fence/shrub establishment <br />azea) have been repaired. Considerable repairs were made south of the elk fence and two <br />additional post mine channels have been constructed and will be monitored to evaluate their <br />functionality. <br />The second azea of erosional concern is located above and to the north of the shrub establishment <br />azea. This is shown on SCC's 2004 Rill and Gully Survey Map. SCC's survey indicates that the <br />rills and gullies will be repaired as necessazy. These rills and gullies were also described in the <br />DMG's inspection report dated July 23, 2004 and were discussed during the site inspection with <br />SCC personnel. This is the location described in our September 1, 2004 letter to Peabody <br />Energy. The DMG will continue to monitor this location. <br />Yoast Mine -Pond 12 Slide <br />The DMG originally noted the slide above Pond 012 as a "Yoast Inspection Report Issue" in our <br />September 1, 2004 letter to Peabody Energy. SCC did not respond to the DMG's comment <br />regarding the slide in your response letter dated October 7, 2004. Therefore, the DMG reiterated <br />our concerns regarding the slide and included some observations obtained during a recent site <br />inspection of the slide area in our last response letter dated October 28, 2004. SCC has <br />responded in the most recent letter and has clarified the DMG's concems. The DMG agrees with <br />SCC's approach to monitoring and repairing the slide-damaged azea above Pond 012 as outlined <br />in the November 16, 20041etter. <br />
