<br />-2- <br />CONCLUSIONS OF LAW <br />4. Based upon these same Findinqs of Fact and in accordance with <br />C.R.S. 34-32-124, the Colorado Mined Land Reclamation Board hereby finds <br />Castle Concrete Company to be in violation of Permit M-77-210, and <br />C.R.S. 34-32-116(7)(q), C.R.S. 34-32-116(7)(h), and C.R.S. 34-32-11617)(1). <br />BOARD ORDER <br />5. Based upon these same Findinos of Fact and in accordance with <br />C.R.S. 34-32-124, the Colorado Mined Land Reclamation Board hereoy orders <br />Castle Concrete Company to take the following corrective action: <br />~t(c{~~4 ~',~~~~ Reclaim the damage to the slope ,lust west of the Phase I area by <br />reseeding and replacing damaged or lost trees by October a0, 1989. <br />1,(~~`t~. Reclaim the damage due to material slides along the access road <br />L~(~~A~"~~ ~ ~ shoulder by completing the geotechnical slope stability analysis <br />I,l~ and submitting it to the Division for review, stabilizing the <br />` slides and erosion, reseeding, and replacing damaged trees by <br />October 30, 1989. <br />1.1~~=(`~~r ~. Based upon these same Findinqs of Fact and Notice of Violation, and in <br />L6 accordance with C.R.S. 34-32-124 the Colorado Mined Land Reclamation Board <br />L~ hereoy modifies the boundary of Permit t4-77-210 to include all areas of <br />off-site disturbances that exist on Castle Concrete Company pro perty, and <br />su mitt,additional bond, as necessary, to cover the cost of reclamation. <br />Ll~~{ ~G Based upon these same Findinqs of Fact and Notice of Violation, and in <br />~~~~, <br />G ` ~~, accordance witn C.R.S. 34-32-124 the Colorado Mined Land Reclamation Board <br />G` hereoy orders Castle Concrete Company to pa.v the Colorado Mined Land <br />Reclamation Board a civil penalty in the amount of b1 ,000, within 30 days of <br />the signature date of this document. This is based upon an assessment of <br />E150.00 per day for 21 days of violation, from July 6, 1989 to July 26, 1989, <br />with $2,150.00 suspended upon completion of the corrective action outlined in <br />this order. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, oar ties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />IJOthing herein contained, particularly those portions requiring certain acts <br />to oe performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />
