.. ~ <br /> <br /> <br />-2- <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Summit Pressed Brick and Tile Co. to: <br />1. Cease and desist from conducting the following mining operations at the <br />Beaver Creek Clay Mine - Permit M-77-322: All mining activities in areas <br />outside of the affected land boundary until such lands are added to the permit <br />by approval of an amendment or technical revision except that the mine access <br />road can be used to access the original permit area. <br />2. Mail, within one (1> day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1> of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. Submit an amendment or revision to permit M-77-322 which will <br />include all affected land within a corrected permit and affected <br />land boundary. This includes all land in pre-1976 area affected by <br />mining activities. The amendment or revision should be submitted by <br />March 21, 1994 and approved within 60 days after submittal. Your <br />technical revision to satisfy this corrective action was received <br />January 24, 1994 and it must be approved by March 25, 1994. <br />Dated at Denver this ~~day of ~ `~\~. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />MICHAEL B.
