Box 533 ) CEASE AND DESIST ORDER <br />Pueblo, CO 81002-0533 > <br />T0: Summit Pressed Brick and Tile Co. and all other persons engaged in or <br />owning or controlling the following operation: Beaver Creek Clay Mine in the <br />NE1/4, Section 35, Township 175, Range 69W, of the 6th P.M. in Fremont County, <br />Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. Summit Pressed Brick and Tile Co. is permitted to conduct a mining <br />operation under the terms of Permit M-77-322 located in the NE1/4, Section 35, <br />Township i75, Range 64W of the 6th P.M., in Fremont County, Colorado. <br />2. The Mined Land Reclamation Board <br />January 27, 1994 to consider possible <br />M-77-322 and C.R.S. 34-32-101 et seq• <br />conducted a Formal Public Hearing on <br />violation of the terms of Permit <br />3. The Division of Minerals and Geology presented evidence at the Formal <br />Public Hearing on January 27, 1994, demonstrating that: <br />a. Summit Pressed Brick and Tile Co. damaged areas outside of the <br />affected land boundary. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />Summit Pressed Brick and Tile Co. to be in violation of Permit M-77-322, <br />specifically Exhibits B and C3, and C.R.S. 34-32-116(7)(h>. <br />
