RE: Final Warranty Release Request; Bestway Paving, Pit No. 1, M-1977-315
Dear Mr. Schreiner:
The following information is being submitted on behalf of our client, Bestway Paving, for the
Pit No. 1 mining operation (M-1977-315). Bestway Paving is requesting release of the permit
and bonding for reclamation. activities and associated costs. The affected azea has been
backfilled, graded, and revegetated consistent with Exhibit E, Reclamation Plan, and associated
amendments and revisions. All backfilling and grading activities on the 28-acre site were done
as mining progressed. Final grading and slope stabilization was fmished in spring 2005 after
mining operations were completed. The owner chose to seed the majority of the pit slopes with
grass and stabilize most of the pit floor with gravel, consistent with the final land use of
industriaUcommercial.
In compliance with Subsections 3.1.1 through 3.1.4 of Section 3.1, Reclamation Performance
Standazds, Construction Material Rules and Regulations, apost-mining land use was established
for the site, approved by the Office, and a reclamation plan was formulated. As stated in
Exhibit E, the final reclamation plan for this site was to return the disturbed ground to
industrial/commercial use. Consistent with Exhibit D, backfilling of the mined pit slopes and
grading activities were concurrent with mining operations.
As listed below, reclamation of the site has complied with additional subsections of the
Reclamation Performance Standards.
3.1.5 Materials Handling
To meet requirements, the following activities were performed.
• Grading created a final topography appropriate for the permitted final land use,
industriaUcommercial.
• Backfilling was performed with adequate compaction for stability. No structures aze
planned for the backfilled slopes, so compaction testing was not necessary.
• No mining highwalls were left on the site and all slopes were graded to control potential
erosion and siltation.
• Grading of all slopes was done as mining progressed.
• No refuse, acid-forming, or toxic producing materials were mined or produced on the site.
