Cattany <br />Division DIfeLYOr <br />Natural Resource Trustee <br />On November 3, 2006, the Division met with Northern Colorado Constructors, Inc. Aggregate <br />Div. (NCCI) and JT Consulting, Inc. to discuss the submittal of Technical Revision 03 (TR-03). <br />Based on the discussion, the Division finds that the changes proposed by NCCI maybe <br />submitted as a technical revision to the permit. However, the following items need to be [/ <br />addressed by the operator prior to approval of the revision; <br />In accordance with Rule 6.4.7(2)(b), the Division requests that NCCI identify and <br />characterize the aquifer to be mined in or through. The Division also requests that the <br />applicant define or predict the cone of depression expected for any azeas to be <br />dewatered and dry mined during the life of the operation. The cone of depression <br />assessment should define, at a minimum, the horizontal and vertical extent of <br />drawdown expected. If during the assessment, the applicant determines that a <br />drawdown will occur offsite that may impact a current groundwater user, the <br />applicant should explain any mitigation measures to be implemented and trigger <br />points that would put mitigation measures into effect. <br />2. Please discuss the mining phases for the site, and the acreage of affected land at any <br />given time. In particulaz, NCCI is currently approved to mine no more than 10 acres <br />that would cover one section or portions of two sections and with a total disturbance <br />at any time of 25 acres. <br />3. Please discuss the changes to the hydrologic balance from the current approved <br />mining and reclamation plan to the proposed plan in TR-03. <br />4. NCCI must provide surface use agreements for all utilities that will be mined through. <br />Until such agreements aze reached, NCCI must not mine within 200 feet of any <br />permanent man made structures. <br />5. During the initial adequacy review of the permit, NCCI committed to not mining <br />within 200 feet of a permanent man made structure until they have obtained <br />agreements with the owner(s) of the structures. Please provide the agreements in <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
