CARPENTER <br />DALE TOOLET <br />11933-19851 <br />I understand that you have copies of Kerr's Notice of Appeal of Judge Child's <br />denial of temporary relief from the NOV issued by OSM on May 25, 1994, and Kerr's <br />Motion for Interim Temporary Relief and Expedited Decision. Enclosed for your <br />information is Judge Child's Order Approving Record, which certifies the record to the <br />IBLA for that appeal, and OSM's Brief opposing Ken's request for interim temporary <br />relief. <br />Also enclosed aze copies of Ed Kay's letter to Steve Renner dated August 22, <br />1994, denying the DMG's informal appeal of the TDN issued simultaneously with the <br />NOV. Also enclosed is Steve Rathbun's report of his inspection on August 24, 1994, the <br />Failure to Abate Cessation Order he issued that day, and one of the Notices of potential <br />individual liability received by Kerr's officers as a result of that inspection. <br />I understand the State is considering intervention in the cases which have been and <br />maybe filed with the Interior Department's Office of Hearings and Appeals ("OHA") <br />regazding this matter. The procedural rules governing such cases aze set forth at 43 <br />C.F.R., Subpart L (§ 4.1100 gt seq.).
