The Division will also request waivers from the landowners of <br />the road in Section 22 regarding the retention of the road in its present configuration. <br />Ownership of the east half of Section 22 is uncertain, however, as there seems to be an error <br />in the Las Animas County records as to who exactly owns the portion of Section 22 where <br />two of the three road ponds exist. We have attempted to notify the current landowners to <br />resolve the ownership issue, but only one of the two entities in Section 22 has responded to <br />date. We will renotify the second owner, to resolve the matter. Should we not receive word <br />from him by November 30, 1993, we will proceed with initiating the process for reclamation <br />of the mine site. <br />With regard to your questions about the administrative expenses associated with this <br />reclamation project, I discussed this with Mr. Jim McArdle of the Inactive Mines Program <br />on November 10, 1993. Mr. McArdle is a Senior Environmental Protection Specialist <br />familiar with Bid Document Proposals for reclamation projects, and was present at the <br />September 1, 1993 inspection, Mr. McArdle informed me that there is no specific <br />percentage of the overall project funds that is set aside for administrative expenses. This is <br />because some jobs have forfeited bonds of only $500.00, and as such, Gave a high percentage <br />of the monies expended for administration. Other jobs, on the other hand, may have <br />forfeited monies in the neighborhood of $350,000.00, and as such have a much lower <br />percentage of administrative expenses. In the case of the Trinidad Basin Mine Reclamation <br />Project, Mr. McArdle estimated the administrative costs will be between $7,000.00 and <br />$8,000.00, or between five and six percent of the overall project costs. <br />Regarding your questions about the time between Reclamation Project Bid Openings and Bid <br />Awandings, Mr. McArdle indicated that this time period is usually three to four weeks. <br />I hope this letter has satisfactorily provided your office with responses to the unanswered <br />questions raised in our earlier conversation.
