Long Divivon Diretlor I just wanted to take this opportunity to follow up on the conference telephone call held last week between you, me, Colorado Assistant Attorney General Steve Brown, and Frank Bartlett of Trinidad Basin Mining Company. I have enclosed, per your request, a copy of the letter transmitted from our offices to the Department of Administration reganfing the collection of $10,750.00 in outstanding civil penalties owed the State of Colorado by Trinidad Basin Mining Company. With regard to your office's questions about the development of a final rechunation plan for the Trinidad Basin Mine, the Division met wiW Mr. Frank Bartlett and Mr. Greg Lewicki, representatives for Trinidad Basin Mining Company, on September 1, 1993 at the mine site. At the conclusion of that inspection, the Division and Trinidad Basin Mining Company were in agreement as to what would be recLLimed, save for three ponds situated along an access road in Section 22, and with possible illegal mining disturbances in Section 15. Since that meeting the Division has determined that the disturbances in Section 15 are not attributable to Trinidad Basin Mining Company, and as such will not be reclaimed with monies from the forfeited Trinidad Basin Mining Company bonds. The Division has further determined that leaving the access road into Section 22 as it is now, with some minor repairs, rather than recon5guring it to the contours of the hillside, will reduce the cost of the reclamation, while at the same time leave ponds for use by livestock and wildlife per the approved post-mining land use. This cost reduction will further afford the Division the opportunity to better address the realignment of the north-flowing surface water runoff that is currently impacting We Del Agua bridge. ~ubl~~ ~'urr~s~,~n.i~,,.:.
