I want to take this opportunity to renew our request for a site visit. <br />Given the appazent confusion about the purpose of the visit, I also want to explain the basis for <br />my eazlier request- <br />As you know, the Colorado Division of Minerals and Geology has issued a Notice of <br />Violation ("NOV") to Basin Resources, Inc. This NOV is based on "water line damage, pasture <br />damage, and structural cracking at the residence and gazage [at the Tatum property], which has <br />occurred since the damage previously addressed by the IBLA Wiling of July 26, 2000" <br />Basin Resources has requested review of this NOV before the Colorado Mined Land <br />Reclamation Boazd. Your clients, the Tattuns own the property at issue in the NOV. On <br />Wednesday, November 15, 2000, I asked the Division to make arrangemenu for Basin Resources <br />to inspect the property. The Division spoke to your clients, who instructed the Division to ask <br />me to make arrangements for a site visit through you. I did so. I understand now that you had <br />not yet received my last correspondence, and therefore did not have a complete understanding as <br />to the purpose of my request. I apologize for that confusion. <br />When we spoke in the course of arranging the site visits, you mentioned the possibility of <br />a site visit during the first week of December. The experts working for Basin Resources should <br />be able to conduct a site visit during that week. You also expressed some concern that this visit <br />be conducted pursuant to "discovery" in the Board's review process. To preserve formalities, I <br />will send a written request to the Division for a site ~~sit. While the Tatums are not yet parties to <br />this proceeding, I will copy you on this request. Please understand, however, that my initial <br />request to the Division to aaange this site visit performed an identical function.
