I. General Comments
The areas inspected included the refuse disposal area, lay down areas, coal
preparation plant, roads and sediment ponds 6 and 7. During the April 17,
1985 inspection two violations had been written. C-85-033 was written for
failure to salvage topsoil in the refuse disposal area. The abatement was to
salvage the topsoil underneath the overcast material and salvage all
recontaminated topsoil underlying the refuse material, also, to create a
buffer zone to insure protection of unremoved topsoil.
At the time of this inspection, the underlying topsoil had been salvaged but
the buffer zone had not been established. The refuse area was much too wet to
conduct any salvage work.
NOV C-85-034 was also written on April l7 for failure to properly construct
the subdrainage system underlying the active refuse pile. Abatement for that
NOV was to remove the coal refuse that extends beyond the present point of
under drain construction, and assure that the existing underdrain is cleared
of refuse material prior to extending the under drain past the point of active
