man-made structure. Therefore, prior to approval of your 112 application, you will need to <br />demonstrate how compliance with Rule 6.4.19 will be achieved for each structure located within <br />your proposed 309.83 acre permit azea. <br />Rule 6.4.19 specifies that where the mining operation will adversely affect the stability of any <br />significant, valuable, or permanent man-made structure located within two hundred (200) feet of <br />affected land, the applicant may either;. <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest in <br />the structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) where such an agreement can not be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities <br />occuring at the mining operation. <br />Once again, I will look forward to your response on or before May 29, 1998 to allow adequate <br />time for review before the June 4, 1998 decision date. You may request an extension of the <br />decision date or waive your right to a decision within 90 days if additional time is needed to <br />prepaze and submit an adequacy response: However, this request must be in writing and must be' <br />received by June 4, 1998. Also, Rule 1.8.1 states that changes and additions to the permit <br />application must be filed with the Division and the County Clerk and Recorder.
