Page 30 of the application lists 10 shallow alluvial wells that occur within 600 feet of the <br />proposed operation. Megan Sullivan of the Office of the State Engineer has stated that prior to <br />approving a well permit, the applicant must document the locations of all wells within 600 feet of <br />the permit azea and obtain a waiver of objection from all well owners with wells within 600 feet <br />of the permit azea or request a hearing before the State Engineer. Please indicate how <br />compliance will be achieved with Rule 3.1.6(1)(a) regazding Colorado water laws and <br />regulations governing injury to existing water rights. Please see attached comments from the <br />Office of the State Engineer. <br />Exhibit J -Vegetative Information <br />1. As required by Rule 6.4.10, please indicate if there aze any noxious weeds present within the <br />proposed 309.83 acre permit azea. If so, you will be required to provide a weed control plan for <br />the noxious weed(s) present in order to achieve compliance with Rule 3.1..10 (6). Please see <br />attached comments from the Longmont Soil Conservation District. <br />2. As required by Rules 6.4.7(4) and 6.4.10(1)(a), please indicate~if there aze any wetlands <br />within the proposed 309.84 acre permit azea:,' If so, please revise the Existing Conditions Map to <br />include the location of any wetland(s) and provide a description of how potential impacts to these <br />azeas will be minimized. Please see attached comments from the U.S. Army Corps of Engineers. <br />Exhibit L -Reclamation Costs <br />Page 38 of the application lists a total reclamation cost of $228,000 for a maximum allowable <br />disturbance of 45 acres at any one time. T'he Division concurs with this estimate. However, in <br />view of comment number 1 under Exhibit E - Reclamatio Plan, please be advised that bonding <br />costs may change depending on adequacy review responses. <br />Exhibit S -Permanent Man-Made Structures <br />Page 1 of the application lists six (6) laterals and irrigation ditches that meander through the <br />property.
