mining area, have been discussed in considerable detail in the Applicant's Application to
Amend M-2001-085 of December 2002. The activities proposed by this Application to
Amend M-2001-085 will have no significant effects on these groundwater resources.
Water removed from the ski lake during dredging will be returned to the lake.
Exhibit H -Wildlife and Cultural Information
A search of the Colorado Natural Heritage Program's (CNHP) Biological and
Conservation Data System for occurrences of significant natural communities and raze,
threatened or endangered plants and animals did not reveal the presence of any such
natural heritage resources within Section 35 of Township 1 South, Range 67 West. The
letter report of June 12, 2002 from the CNHP is attached to this Exhibit H.
All mining azea currently covered by DMG Permit No. M-2001-085, as well as areas
proposed for addition to the permitted area by this Application to Amend M-2001-085,
lie within a block clearance zone of the Denver metro area for the federally listed,
threatened Preble's meadow jumping mouse. The block cleazance zone, as designated by
the U.S. Fish and Wildlife Service, is an area where that agency has determined that the
species in question is no longer likely to exist. The designation eliminates the need to
coordinate with the U.S, Fish and Wildlife Service prior to conducting development
activities within the block clearance zone.
A search of the Colorado Inventory of Cultural Resources by the Colorado Historical
Society's Office of Archaeology and Historic Preservation has identified six sites within
Section 35, Township 1 South, Range 67 West of the 6`h PM. Four of these sites aze not
in the southwest quarter of Section 35, where the land proposed for addition to the
permitted area is located. One of the two "sites" within the southwest quarter of Section
35 is on the east side of the Fulton Ditch and was determined in 1994 as "Officially Not
Eligible" for listing on the National Register of Historic Places.
The sixth site, identified by the Colorado Inventory of Cultural Resources as located in
the SE SE SW SW quarter of Section 35, is a segment of the Fulton Ditch adjacent to the
very southeast corner of the site. This segment of the Ditch was assessed in 1994 as
retaining its historic features and considered a "contributing element" to the Fulton Ditch,
which, in 1984, was deemed in its entirety as eligible for listing on the National Register
of Historic Places. A copy of the Colorado Historical Society's site data, pertaining to
this segment of the Fulton Ditch, is attached to this Exhibit H.
6
Application to Amend 124`" Estates Partners
DMG Regular 112 Reclamation Permit M-2001-085 124`h Estates Sand and Gravel Mine
Prepared by Scott Keen -September 2003 He^derson, Colorado
