There is no evidence that the elevated cyanide levels have i any way <br />impacted surface or ground water in the vicinity of the site. Thereto e, BMRI was <br />not required to cease using cyanide so long as it meets the standards rescribed by <br />the Board. Therefore, as described in the May Order, it is necessary to enhance <br />ground water monitoring at the site. It is unlikely that any impacts o ground <br />water will pose a hazard to the health and welfare of the public prior) to the <br />installation of additional necessary ground water monitoring wells. <br />7. BMRI has made a good faith effort to reduce cyanide levels ih the ponds, <br />and by using the hydrogen peroxide process, has achieved a substantiallreduction in <br />such levels in the tailings ponds. By continuing to operate the plant, and <br />continuing to treat the solution using the hydrogen peroxide method, t e Division <br />believes that BMRI should be able to continue to reduce the WAD cyanid level to <br />less than 15 ppm in the active lower pond and to less than 10 ppm in t e inactive <br />upper pond. Implementation of the INCO S02/Air tailings treatment pro ess by <br />BMRI, scheduled for early October of 1992, is intended to bring the cy Hide levels <br />within both tailings ponds into compliance with the permit standards o 4.4 ppm <br />total cyanide and 3.8 ppm WAD cyanide. <br />8. Pursuant to paragraph 5 of the June Order, the Board held a Baring on <br />July 22, 1992 to consider issuance of a compliance schedule for reduci g the level <br />of cyanide to 4.4 ppm total cyanide and 3.8 ppm WAD cyanide. <br />9. following the July 22, 1992 hearing, the Mined Land Reclamation Board <br />("Board") issued an additional corrective action order dated July 22, 992 ("the <br />July Order"), which among other things required BMRI to maintain the w ak acid <br />dissociable (WAD) cyanide level in the actives tailings pond at less t an 15 ppm, <br />and in the inactive tailings pond at less than 10 ppm, commencing imme iately. The <br />order also required BMRI to implement the INCO S02/Air tailings treatm nt process <br />proposed in TR-010 as soon after approval as possible. further, the 0 der required <br />BMRI to use all reasonably practical steps to continue to lower the cy Hide levels <br />in the ponds to the lowest reasonably achievable levels, and to contin e to use its <br />best efforts at all times to achieve that goal. The order directed th Division to <br />provide the Board with a status report on the detoxification process a the August <br />26, 1992 Board meeting. The Board also directed the Division to recom end a <br />compliance deadline for reducing the level of cyanide to 4.4 ppm total cyanide and <br />3.8 ppm WAD cyanide. <br />ORDER <br />Based on the foregoing, the board hereby enters the following additional corrective <br />action order: <br />(1) BMRI proposes to implement the INCO SO2/Air tailings treatment pr cess <br />described in TR-010 as a final process to achieve and maintain co pliance with <br />the cyanide level permit standards specified in the permit. 7R-0 0 was <br />submitted to the Division on June 16, 1992 and was approved July 1, 1992. <br />BMRI shall commence operation of the INCO Process as soon as pons ble, in <br />-2- <br />
