BINGHAM: I think this is--well, it's most <br />unique in one way and it is the most disturbing situation I <br />have ever been in. I get a Cease and Desist Order, except <br />flood-control project, which is the only thing we do. <br />And yet, now--I did call Mark and verbally we <br />agreed that i°lood control is the removal of gravel from the <br />river, which he said "You can go ahead and do it." And now <br />you want to fine me for it. <br />I might add that we have not operated. We <br />have even ceased our flood-control work because of these <br />various things. If flood-control work is mining, and if <br />it's permissible under a Cease and Desist Order, I don't <br />see why there should be any penalty involved. <br />MR. BROWN: Uo you see what our problem is, <br />though? We have got to draw a line, what's mining and what's <br />not mining. <br />MR. BINGHAM: Right. <br />MR. BROWN: One of the lines we have drawn is <br />commerciality, whether or not you are selling it. So, we <br />have hit the problem time after time, and that's one of the <br />places where we have drawn a line; I don't know whether you <br />would do it any different or not.
