lz
1
MR. HOLDER: If we specify a minimum fine, we
• 2
'
will have to stick to it, and our softness won
t enter into
3
it; and we will pass the buck to the legislature.
4
THE CHAIRMAN: Would any member6 of the Board
5
like to make a Motion?
6
MR. HOLDER: I have one question. You said
7
certain things you have not taken into account when you made
8
your recommendation. Do you care to change your recommendation
~
now, taking into account--
10
MR. LOYE: Quite frankly, I think I will let
11
the Board make a decision on the civil penalty. Mine was
12
made mainly on the thought that this was an ongoing operation
• 13
for sometime. Even though some misinformation may have or
14
may have not been relayed to Mr. Bingham. And the Board may
15
make any considerations as they wish. In truth, this partic-
16
ular operation, in effect, the mine is less than a year old
17
by virtue of what Mr. Bingham has told us. That changes that
1S
particular consideration to some extent. I'll let my partie-
19
ular. consideration stand, and I will let the Board do what-
20
ever they want to.
21
THE CHAIRMAN: Okay. Board?
22
MR. BROWN: I would move that we fine
23
Mr. Bingham $2,000 with a suspension of $1,600 contingent
24
. upon permit approval within 60 days.
~25
MR.
