Box 1.030 <br />Colorado Springs, CO 80901 <br />Jerry, <br />In response to otu conversations and your letter of Jul y 14, 2004 regarding the summary of the <br />on site meeting of the Chain of Lakes property on July 13, 2004 attended by representativeR oP <br />State Pazk.R, Transit Mix Division of Minerals & Geology (DMG), I have the following <br />comments concerning the items as outlined in your letter. <br />T.tetns 1, 3, 4, 5, 6, 7, 8, 9, 10, and 12 are as we discussed during the on site review and arc <br />acccptableto uq. <br />Item 2, Eradication of all Russian Olives and Tamarisks on the requested relcaso land, except for <br />those plants located in the CDOT drainage easement area just north of Highway 96 near tfie west <br />side of the release area. This land was not disturbed by the mining process and presently <br />incorporates wetlands. Removal would harm these wetlands as well as destroy a very pteaaing <br />visual area. Furthermore, these species azc bound by the highway as well as the drainage ditch, <br />which will limit their proliferation. <br />State Parks desires to have those Tamarisks and Russian Olives also removed from the area in <br />the CDOT drainage area. State Parks would reconsider this position if DMG permits those <br />Tamarisks and Russian Olives in the CDOT drainage area to remain. <br />Item 11, Change to: Transit will acquire treatment materials, AS SPECIFIED BY STATE <br />PARKS, for the treatment of standing water in the CDOT drainage ditch area FOR TI-I8 <br />PURPOSE OF MOSQUITOE ERADICATION AND THE PREVENTION OF WEST NILE' -- <br />VIItUS. <br />Item 13, Change to: All other reclamation items within the on site inspection arcs and accepted <br />by DMG will be accepted by Colorado State Parks- <br />Per our conversation I understand that you also added an item 14 in which Transit agrees to <br />grade and dress the roads between the western ponds. <br />STgTE OF C.OLORApO • COLOWLOO sTATE PARKS <br />BIII Ovrene.
