western easement line with the City of Pueblo's eastern Goodnight Barn
line will not require placement of top soil and seeding.
Item 7 * Transit will remove the concrete slabs at the eastern end of the aggregate
plant storage area and use as reclamation material in the southern most
lake. Transit will fill and groom the created void.
Item 8 * Colorado Parks and Transit will jointly establish signage to evidence
ownership and promote control of each other's property.
Item 9 * Transit will leave the road, which crosses the CDOT drainage ditch, from
the eastern most top soil pile in the western area.
Item 10 A Transit will provide, at no cost to Colorado Pazks, weed control on the
entire release azea for two years from the closing date of May 4, 2004.
Item 11 A Transit will acquire treatment materials for the treatment of standing water
in the CDOT drainage ditch. Colorado Parks will apply the materials.
Item 12 * Transit will close the storm water runoff drainage from its industrial site
before it enters Colorado Parks land. In exchange for this conversion,
Colorado Pazks will allow storm water to enter State land, both from the
western most boundary of Transit's easement with the Ciry of Pueblo's
Historical Goodnight Barn and from the City's properly. This area
approximates three acres.
Item 13 * Grade the existing roads between the western three lakes.
Item 14 All other reclamation items will be accepted by Colorado Pazks as they
currently exist.
Note: The * located by several items indicates that these items should be
completed by the anticipated September release.
The "A" located by four items indicates that these will be ongoing projects
which will terminate two years from the closing date of May 4, 2004.
The approximate 10 acre industrial land site of Transit will be requested
for release in a separate document.
Sincerely,
J/ err~rman~
Vice President
