landowner at the site of the Spring Creek Pit site. United Companies has a Minine <br />Lease with S&R Delta Partners LLLP at the Spring Creek Pit site. A copy of <br />Amendment Number One to Minine Lease between S&R Delta Partners LLLP and <br />United Companies describing their agreement with respect to the new access road is <br />attached. <br />Exhibit O -Owners of Record of Affected Land (Surface Area) <br />The owners of the land that is affected by this proposed amendment aze Robert and <br />Irene Schleich of 61253 LaSalle Road, Montrose, CO 81401. A copy of the Montrose <br />County Assessor's Office record for the parcel is attached. <br />In addition, a list and map showing all landowners adjacent to the access road site and <br />the Spring Creek Pit site is attached. <br />Exhibit P -Municipalities Within Two Miles <br />There aze no municipalities within two miles of the site. <br />Exhibit Q - Proof of Mailing Notices to Board of County Commissioners and Soil <br />Conservation District <br />Proof of delivering notices of this proposed Amendment to both the Montrose County <br />Board of County Commissioners and the Boazd of Supervisors of the Shavano Soil <br />Conservation District are attached. <br />Exhibit R -Proof of Filing with County Clerk and Recorder <br />Proof of filing this amendment application with the Montrose County Clerk and <br />Recorder is attached. <br />Exhibit S -Permanent Man Made Structures <br />The construction of the road will not adversely affect the stability of permanent man- <br />made structures. Three structures exist at the site: <br />1. A fence at the east boundary of the Schleich property that is owner by Mr. and <br />Mrs. Schleich. <br />2. An unlined irrigation ditch near the east boundary of the Schleich property that <br />is owned by the Uncompahgre Water Users Association. This structure is <br />named in Item 3 of the Easement Agreement. <br />3. An irrigation system owned by Mr. and Mrs. Schleich that lies on the west side <br />of the access road for the most part. This structure is named in Item 3 of the <br />Easement Agreement. <br />Contained in Item 4 of the Easement Agreement is the requirement that the Grantee <br />(S&R Delta Partners LLLP) shall bear all costs of construction and maintenance of the <br />easement. As the permit holder and operator of the Spring Creek Pit (through our <br />Mining Lease with S&R Delta Partners LLLP), United Companies is responsible for <br />the maintenance of the easement. This has been specifically described in the <br />Agreement section of Amendment Number One to Mining Lease between S&R Delta <br />
