r <br />• <br />There is no reference in the permit that the piles will be <br />stockpiled for months to allow the coal refuse to dry. Drying of <br />the coal refuse is stated in the permit to be achieved by spreading <br />out the refuse in layers of 2" thick. <br />On RP-4 there was a large depression in the middle of the refuse <br />pile. This depression is roughly 200 feet in length and 200 feet <br />in width. There was no standing water in the sump during the time <br />of the inspection. As a temporary measure, the operator cut a <br />trench through the depression to outlet any potential buildup of <br />water. Photographs were taken of this area. According to the <br />Deserado permit: <br />"refuse material will be placed so that no ponding or <br />surface water can occur on or behind the waste bank. <br />Lifts will be sloped off to the sides so that the runoff <br />will not run off the front face of the bank. Runoff will <br />be picked up in the diversion ditches located along the <br />toe of the refuse bank where it intersects the original <br />ground" (IV-32). <br />It is apparent that the operator was not following the approved <br />mine plan in constructing RD-4 by allowing for such a large <br />depression in the middle of the refuse pile. <br />NOV C-93-103 was written based on a site inspection and reclamation <br />plan in the Deserado mine permit. <br />m:\coal\esc\930714e <br />
