Long <br />Drvis~on Dneclrn <br />On July 1, 1993 the Division of Minerals and Geology wrote Notice <br />of Violation C-93-103 to the Deserado Mine. The nature of the <br />violation was twofold: <br />1. Failure to follow the approved mine plan by failing to <br />place excess spoil in. a controlled manner and concurrently <br />compacting as necessary to ensure mass stability and prevent mass <br />movement (4.09.1(7)) <br />2. Failing to divert surface runoff from the fill surface to <br />stabilize channels of the fill (4.09.2(7)) <br />The inspection was conducted by Erica Crosby and Larry Routten of <br />DMG on June 24, 1993. The main emphasis on the inspection was to <br />inspect the three refuse piles located in the Deserado permit area <br />(RD-l, RD-2-3, RD-4). <br />Refuse pile 2-3 contained an undetermined volume of stockpiled <br />refuse material (yet to be spread or compacted). According to the <br />operator and the previous DMG inspector Janet Binns, the refuse <br />material is placed on top of the refuse pile in order for it to dry <br />before spreading and compacting. Because this was a wet year and <br />the fact that the mine was producing more refuse material than <br />normal, large piles were placed on RD 2-3 in order to be dried <br />(piles were 10-15 in height). This material has been stockpiled <br />since the winter months (See marked slides). Because there is far <br />more stockpiled refuse material on RD-2-3 than could be spread, the <br />mine has to haul some of the material to RD-4 to be spread and <br />compacted on that pile. This has turned RD-2-3 into a refuse pile <br />dump where the material is dried rather than being concurrently <br />spread and compacted. <br />The Deserado mine plan states that: <br />"refuse is dumped in an area and spread into layers 2" <br />thick to dry. After drying refuse is built into layers <br />not exceeding 2 feet and compacted to 90% density" (IV- <br />29). <br />
