<br /> <br />Residual fill that cannot practically be removed from <br />the Creek without causing excavation or further <br />damage to the original Creek bank will be retained in <br />the Creek. <br />3. Commence revegetation activities of the 25 foot <br />buffer and berm located atop and immediately <br />adjacent to the east bank of the affected reach of <br />Spring Branch Creek. Revegetation will not occur on <br />the outslopes of the berm oriented into Spring Branch <br />Creek. <br />Also, commence revegetation of the Creek bed <br />immediately adjacent to the mine area and as visibly <br />impacted by sediments from the berm and washed out <br />access road where it crossed Spring Branch Creek. <br />It is understood that no targeted cover of vegetation <br />will be expected for the area seeded within the Creek <br />bed. Revegetation may use broadcast or drill <br />methodologies. <br />It is also understood that treating areas not presently <br />contained within the permit boundary as part of the <br />agreed to Corrective Action will not constitute such <br />areas as "affected land" and such areas will not <br />require inclusion into the permit as part of this <br />Corrective Action. <br />Further, it is understood that the U.S. Army Corps of <br />Engineers must also approve of this Corrective Action <br />where it impacts Spring Branch Creek under their <br />jurisdiction, and may require modifications for which <br />the CMLRD will not place Elbert County in a situation <br />whereby it could not comply with such modifications <br />or requirements of the U.S. Army Corps of Engineers. <br />4.
