~ III IIIIIIIIIIIII III ~ <br />Thursday 15 August 1991 <br />T0: Jim Stephens, Reclamation Specialist <br />Colorado Mined Land Reclamation Division <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />FROM: Elbert County Board of County Commissioners <br />RE: Permit M-88-101; Fondis Mine. <br />On this date the Elbert County Board of County Commissioners <br />met and approved this resolution to perform Corrective Action at <br />the above named mine site as detailed below: <br />A. Submit this agreement to the Colorado Mined Land <br />Reclamation Division (CMLRD) by Thursday 15 August 1991, to <br />forestal further enforcement action by the CMLRD against Elbert <br />County, as indicated in correspondence from the CMLRD of 3 July <br />1991. <br />B. As part of this agreement Elbert County will perform the <br />following Corrective Actions at the above named site on or before <br />Tuesday 1 October 1991: <br />1. Relocate the berm located on the West boundary <br />of the pit area to the East a minimum of 25 feet from <br />the top edge of the East bank of Spring Branch Creek <br />as a buffer to continued mine activities at the Fondis <br />Mine. Rip rap and revegetation of the outslope of the <br />berm is no longer a requirement under the terms of <br />this Corrective Action Agreement. <br />2. Remove fill material within Spring Branch Creek <br />immediately overcast into the Creek as part of the <br />original construction of the above berm. <br />The loose fill will be removed to a point that <br />approximates the near original vertical bank in place <br />at that reach of Spring Branch Creek prior to <br />placement of the berm. <br />
