interference with fish spawning. To the maximum extent <br />practicable, discharges of dredged and fill material in spawning <br />areas during spawning seasons shall be avoided. <br />12. The project shall be designed to minimize changes in <br />physical characteristics of the water course including subsurface <br />flows which may prevent unnecessary secondary adverse impacts to <br />wetlands dependent on existing hydrologic conditions. When <br />construction operations are completed, the flow of streams shall <br />be returned as nearly as possible to the original pattern without <br />creating a possible future bank erosion problem. <br />13. The roadway crossing shall be designed to prevent <br />restriction of and to withstand expected high flows. <br />14. To the maximum extent practicable, discharges in <br />wetlands shall be avoided and minimized at the project site. <br />Heavy equipment working in wetlands must be placed on mats or <br />other measures must be taken to minimize soil disturbance. <br />Wetlands impacts remaining"after avoidance and minimization shall <br />be mitigated through appropriate compensatory means approved by <br />the Corps of Engineers. Upland areas scarred by construction <br />should be revegetated with an appropriate mixture of native <br />trees, shrubs, grasses and fortis. Exotic plants should not be a <br />part of any revegetation plan. <br />15. Destruction of riparian or riverine vegetation, <br />especially mature cottonwoods, and discharges into breeding areas <br />for migratory waterfowl shall be avoided. The permittee is <br />cautioned that cottonwoods may be locally very important for bald <br />eagles which are protected by the Endangered Species Act {refer <br />to condition number 16 below). <br />16. Any activity authorized under this permit shall not <br />jeopardize a listed species as identified under the Endangered <br />Species Act, or destroy or adversely modify the critical habitat <br />of such species. The Corps of Engineers will contact the U.S. <br />Fish and Wildlife Service on specific requests to perform work <br />under this permit when a project "may affect" a threatened or <br />endangered species, or their critical habitat. The U.S. Fish and <br />Wildlife Service will, in turn, develop a bioligical opinion <br />stating reasonable and prudent alternatives which avoid jeopardy <br />and adverse modication. For example, the following rivers in <br />western Colorado are designated as critical habitat for several <br />fish species protected by the Endangered Species Act: <br /> <br />6 <br />
