STATE OF COLORADO <br /> MINED LAND RECLAMATION BOARD <br /> DEPARTMENT OF NATURAL RESOURCES <br /> IN THE MATTER OF: <br /> MARATHON GOLD COPORATION ) NOTICE OF VIOLATION NO. M-85-013 <br /> TO: Marathon Gold Corporation and all other persons engaged in or owning or <br /> controlling the following operation: Joker Mine and Pilot Plant. <br /> FINDINGS OF FACT <br /> Pursuant to the authority vested in the State of Colorado Mined Land <br /> Reclamation Board by C.R.S. 1973, 34-32-124, as amended, the Board hereby <br /> makes the following findings of fact: <br /> 1 . Marathon Gold Corporation is conducting a mining operation in the <br /> following location: Section 9, T9N, R92W of the 6th P.M. , Moffat County, <br /> Colorado. <br /> 2. The Mined Land Reclamation Division conducted inspections of the <br /> site on November 30, 1984 and February 8, 1985. <br /> 3. On January 24, 1985, the Colorado Mined Land Reclamation Board <br /> (hereafter, the "Board") found reason to believe that violations existed at <br /> the site. <br /> 4. On February 28, 1985, during a Formal Public Hearing, the Board <br /> found Marathon Gold Coporation to be in violation of Permit No. 83-52 for: <br /> a. Operating an unpermitted cyanide pilot plant and disposal of <br /> detoxified cyanide processed sample tailings. <br /> b. Constructing an unpermitted fill/waste rock pile. <br /> c. Failure to grade and stabilize topsoil stockpiles. <br /> 5. In addition, on February 28, 1985, the Board found the operator to <br /> be in violation for failure to maintain adequate financial warranty, in that <br /> the existing disturbance exceeded the 11 acres for which financial warranty <br /> had been posted. <br /> 6. A hearing was conducted February 28, 1985, in accordance with <br /> C.R.S. 1973, 34-32-124(5) . <br />
