<br /> <br />Mr. Mark Loye <br />October 23, 1981 <br />Page Two <br />.. Charles J. Webster has also been heretofore adjudicated as <br />an heir of Ellis B. Webster, Deceased, and in such capacity <br />entitled to an undivided one-eighth interest in and to his <br />Estate. In connection with the partnership claim filed by <br />Charles J. Webster, the probate court in Lake County has <br />appointed a Special Administrator to pass upon the various <br />claims filed in this Estate, including that of the Applicant, <br />Charles J. Webster. The Special Administrator has not yet <br />rendered his report and pursuant to Order dated October 21, <br />1981 has until December 9, 1981 in which to complete his <br />investigation and file his report and recommendation to the <br />Court. Inasmuch as ownership of [Webster Sand and Gravel and <br />Webster Sand and Gravel, Inc. is currently under the jurisdiction <br />of the probate court in Lake County and further inasmuch as it <br />is admitted that the two subject sand and gravel operations, <br />to-wit: The Jones Pit and the West Tennessee Pit, are being <br />operated by Webster Sand and Gravel and Webster Sand and Gravel, <br />Inc. as well as owned by said entiCies, we suggest to the <br />Colorado Mined Land Reclamation Board that they expressly do <br />not make any determination in the granting of the application <br />as to the relative claims of Charles J. Webster and the Estate <br />of Ellis B. Webster, Deceased, with respect to the ownership <br />of the Jones and the West Tennessee Pits and further they <br />make no determination or ruling as to the actual ownership <br />of the Mined Land Reclamation permits that presumably will <br />issue pursuant to the filed applications. <br />It is the position of I`ir. Webster and I am certain the <br />Estate of E11is B. Webster that neither claimant desires <br />their respective claim or interest in and to Webster Sand <br />and Gravel and Webster Sand and Gravel, Inc. or the Jones <br />Pit or West Tennessee Pit or the permits Chereto to be pre- <br />judiced or in any manner compromised by any factual finding <br />by the Mined Land Reclamation Board in connection with the <br />filed applications. <br />For your file, I have enclosed a copy of the filed <br />claim of Charles J. Webster in Lake County probate proceeding <br />as well as a copy of the order appointing a Special Administrator. <br />We further reyuest that inasmuch as one permit application <br />has been filed for the Jones Pit and West Tennessee Pit that the <br />
