EXHIBIT E - A (revised) Reclamation Plan (6.4.5) (2) (a) It is the intent of the landowner/operator to reclaim the affected area to meet the criteria for rangeland development. With the exception of the 110 permit area, reclamation efforts will remain consistent throughout all phases and are discussed as follows: The type of reclamation proposed for the mine phases is to replace the mined area with 1' - 2' of overburden and 6" of topsoil where available. The post-mining slope along mining limits and will be regraded to no less than a 3:1 slope ratio. The method proposed to replace overburden and topsoil will involve slot dozing the respective material from atop the western and peripheral mining boundaries. The area will then be graded to meet the post-mining development requirements. Reclamation contours are shown on Exhibit F. The total mined area to be reclaimed is approximately 90 acres including 9.9 acres within the existing 110 permit boundary. The area comprising the mine property and the surrounding lands are primarily agricultural. The properly is bound on the north, west and south by lands of the Southern Ute Tribe. (b) Implementation of the Reclamation Plan pursuant to Section 3.1 is described as follows: The lands on which mining will take place are owned by the Operator/ Applicant. It is the desire of the landowner to reclaim the mining phases such that it can be utilized as rangeland. Erosion and siltation will be controlled throughout the reclamation process such that lands outside of the affected area will not be impacted. Methods to be employed include effective stormwater impoundment, siltation and erosion control devices. Neither refuse nor acid-forming nor toxio-producing materials are expected to be mined. Should any of these materials be discovered, they will be handled and disposed of in an acceptable manner at the cessation of mining. (c) Within all phases where topsoil is encountered, it will be removed and placed in segregated berms along the perimeter of each mining cell as depicted on Exhibit C. As discussed earlier, topsoil will be revegetated and maintained until it is replaced post-mining.
