<br />'--+~ Rule 2.05.3 (6) - Continued <br />r <br />1:-= <br />' ~. <br />:M _. <br />The overburden stockpile located in Section 24, Township 5 North, <br />Range 86 West, approved under the existing permit No. 76-16, is <br />complete and has already been graded out to receive topsail and <br />seed. Energy Fuels does not intend to add any material to or to <br />remove any material from this stockpile, nor does Energy Fuels <br />intend that this stockpile be included within the purview of this <br />application. This permanent overburden stockpile has not been used <br />since early 1980 and vas graded out to a final stable slope at that <br />time. The Location is shown on Flap 6, Energy dine No. 3 Mine Plan. <br />~, The tae of the stockpile does not extend into the local drainage <br />system and therefore Local runoff will not cause stability pro- <br />blems. The stockpile vas graded out however, to be compatible with <br />- the surrounding terrain from both visual and land use perspectives. <br />~- The top of the stockpile is sloped back from the outs lope in order <br />to control erosion. <br />~.. <br />The two overburden stockpiles located adjacent to the Middle Creek <br />,R .~ Underground Mine are temporary and will be used to backfill the <br />portal area upon completion of mining. The location of these piles <br />~^'':' are shown on Map 6, Energy Mine No. 3 Mine Plan. <br />~_ <br />(7) Coal Handling Structures <br />A narrative and appropriate map, prepared to meet the standards of <br />2.10, generally explaining the location, construction, modification, <br />use, maintenance and removal of coal removal, handling, storage, clean- <br />ing, and transportation areas and structures in accordance with 4.01.1. <br />2.05 - 28 <br />
