There is wetland type vegetation (i.e.: cattails, willows) in the southerly portion of Affected <br />Area Pazcel 1 in the azea labeled "Area in Reclamation" on Pre-Mining & Mining Plan Maps and <br />as Phase I on the Reclamation Plan. As discussed in the Reclamation Plan the area is vegetated <br />and no mining activities will occur there. This area is undisturbed by this applicant and will <br />remain undisturbed. The area is nearly flat and completely covered with native vegetation. We do <br />not anticipate any reclamation efforts in this area beyond leaving it undisturbed. <br />Exhibit L- Reclamation Costs <br />23. The Applicant acknowledges that this estimate will be prepared by the Division. <br />Exhibit M -Other Permits and Licenses <br />24. The Certification issued under the Colorado Water Quality Control Act by the Colorado <br />Department of Public Health and Environment is attached as Attachment "C" <br />Exhibit S- Permanent Man-Made Structures <br />25. The landowner granted an easement to Chaffee County for access to and along the Arkansas <br />River in December, 1992 (copy attached as Attachment "D"). This easement was then transferred <br />to and is currently managed by the Colorado Division of Wildlife as the Champion Fishing <br />Access. The easement is 50 feet on each side of the Arkansas River with a 10 foot wide <br />pedestrian walkway leading down from 5 parking spaces near Highway 24. The parking area and <br />walkway are on the southerly side of Maxwell Creek, entirely outside of the Affected Areas. This <br />easement has been added to the maps. Although this easement was granted after the permitting of <br />the original pit, a portion of the easement does lie within an easterly portion of Affected Area - <br />Parcel 1. A Right of Entry Letter from Division of Wildlife is attached as Attachment "E". <br />26. The letter from the Colorado Historical Society is noted as are the requirements if human <br />remains are discovered. <br />We appreciate this opportunity to provide additional information and clarification regarding this <br />Operation.
