The only water to be used in this mining operation will be for dust control. We estimate this <br />use at the rate of 1 acre foot per year. Water rights are obtained by lease agreement from the <br />Upper Arkansas Water Conservancy District, a copy of the Water Lease Agreement is attached as <br />Attachment "B". <br />16. CLARIFICATION: of the term "dewatering". There will be no pumped removal of water as <br />part of this operation. More correctly, we will be isolating product from tailings water from up- <br />gradient agricultural use so that the water will drain from the product. The area to be drained of <br />tailings water from up-gradient agricultural use is the hillside on the west side of Affected Area <br />Parcel 1. This hillside is approximately 4 acres in size. When the relocated diversion ditch <br />(shown on the mining plan) is constructed, we anticipate the eventual draining of the entire 4 <br />acres. <br />17. There is one well, owned by the surface owner, within 600 feet of the affected land. This well <br />has been added to the maps. Please refer to the similar discussion in items 3 & 4. <br />18. Based on the elevations discussed in item 13, we expect an overall depth to groundwater of <br />15 to 25 feet below the pit floor. <br />19. This operation will not excavate into or through any aquifer and will therefore not create any <br />cone of depression. <br />20. Disturbance to the hydrologic balance will be minimized during mining & reclamation by not <br />disturbing or excavating into any groundwater or aquifer. Pelino Inc. will be in compliance with <br />Colorado Water Laws and regulations governing injury to existing water rights by maintaining <br />and implementing a Stormwater Management Plan, a Colorado Wastewater Discharge Permit, a <br />Temporary Substitute Water Supply Plan, a Water Lease Agreement and a Gravel Pit Well <br />Permit. The conditioris of approval by the Office of the State Engineer aze hereby acknowledged <br />and this document and attachments aze offered as demonstration that we are moving toward full <br />compliance. The Water Lease Agreement is attached as Attachment "B". The Temporary <br />Substitute Water Supply Plan and the Gravel Pit Well Permit will be forwarded to the Division <br />upon their approval. <br />21. Please refer to the clarification in Item 16. All tailing water and storm water will be routed to <br />diversion ditches that will run to the sediment ponds. <br />• <br />
