Comments also describe any <br />enforcement actidhs taken during the inspection and the }acts_or evidence <br />suooortino the enforcement action. <br />This waa.a,complete irtapoction of the Weat fills Mine completed by' <br />Christine Johnston of the Divialan. Henry Austin of the Jffice of <br />Sttrfuce Mining was present along with Henry Barbs representing <br />Mountain Coal Cgnperty. The inspection was conducted over three <br />.days; the first day consisted o4 cltecking records atrd.,irhe, remainder <br />of the time was spent doing ~ he site inspection. The first day wtA: <br />cloudy and reining periodically and the other two days were clear <br />ant! worm, <br />. , <br />AVAIL•aBIL•ITY ON RECORD <br />•; <br />West Gllc's roviaed SPCC plan requiros visual inspections to 6e done <br />annually in August. Aocording to the operator, this.i.p.apection hsa <br />been completed but nt the tine of the Diviaton'a inspection, the <br />Porm contained in tl~e 6PCC plan had not been filled out. The <br />results of this inspection ahould.be entered in this form prior to <br />the Division's next complete inspection. Pond inapec~tiona should <br />continuo to be completed ort a quarterly basis. The DH~ permit is <br />on file and expires on July 91, 1996. The inspectors recommended <br />that annual certifications be completed ott all ponds, not Suet the <br />oversized ponds. !t wras determined that proper notice had not been <br />. given to aurtace landowners over areas to be mined; Lhercfore, NOY <br />C-93-112 was issued. <br />An additional permit boundary .marker should be placed on the <br />~• eastern end of tits loadottt. The permit boundary marker on the <br />fence which faces the river should bo replaced with a Mountain Coal <br />Coutparty e i gn . <br />0 DS <br />There la curtently a light-uso road around the 6aee o[ the refuse <br />pile that was constructed without Division appcoval; therefore, NOV <br />C-93-l1a was issued• In addition, MCC has a number of light-ttac <br />roads that are used to access upper areas for martltoring purposes <br />that have not 6cen included itt the permit document's description of <br />1•ight-•.tae roads. MCC should surve~• the mina site for all light-use <br />rondo for ittcltt:.iott 'in the pec•mlt. Rtt.lw 1.0.1.111(c) defines a <br />light-use road. There are several watec• bars along the road used <br />to resclt the upper meadow, t+hiclt a{;pear to be functional. There is <br />howe:•er, some et•osiort occtt:•riug ott the lowrr reaches oi' this road. <br />MCC should consider t•egt•nding this c•oad. <br />
