The compliance record for the Somerset Mine has been problematic <br />in the recent past; however, Somerset Mining Company appears to be taking affirmative steps <br />to improve the situation. <br />It is our understanding that Somerset Mining Company will hire an environmental compliance <br />coordinator by June 1994, and this coordinator will have both the authority and budget to <br />ensure that environmental compliance remains in effect at the Somerset Mine. !t is also our <br />understanding that Somerset Mining Company has developed an internal audit and training <br />system to support the efforts of the compliance coordinator. Finally, it is our understanding that <br />all compliance-related issues will be overseen by Somerset Mining Company management <br />personnel, with a company policy in place which emphasizes environmental compliance. <br />Based upon these commitments conveyed both in writing and during the meetings of <br />February_ U, .1994 and-March 24, 1994, it is our-belief that Somerset. Mining. Company- is <br />adequately addressing the compliance problems at this-time. Given the specific circumstances <br />involved in this case, and our belief that Somerset Mining Company is working aggressively to <br />resolve the previous compliance issues, we find that, at this time, the issuance of a 'show <br />cause order' would be demonstrably unjust. <br />.Please understand that if compliance problems continue, or if it appears that the proposed <br />compliance plan is not being adequately or successfully implemented, our decision will be <br />reconsidered.
