2 <br />Under §3715.7-1(c)(1), a noncompliance order may be issued if <br />your use or occupancy is not in compliance with any requirements <br />of this subpart. Under §3715.5-1 "you must remove all permanent <br />structures, temporary structures, material, equipment, or other <br />personal property placed on the public lands during authorized <br />use or occupancy under this subpart. You have 90 days after your <br />operations end to remove these items." You have also failed to <br />comply with this requirement as defined in our March 11, 2002 <br />correspondence. <br />Once again, be advised that 93CFR 3715.5-2 states: <br />Any property you leave on the public lands beyond the <br />90-day period described in §3715.5-1 becomes property of <br />the United States and is subject to removal and <br />disposition at BLM's discretion consistent with <br />applicable laws and regulations. You are liable for the <br />costs BLM incurs in removing and disposing of the <br />property. <br />The 90-day deadline from your initial notification date of March <br />11, 2002, expired on June 11, 2002. Enforcement of these <br />regulations as defined at §3715.5-2 will depend upon your <br />cooperation and communication with this office, and also with <br />respect to the completion of the required reclamation <br />responsibilities at your Joker Mine project. <br />Be advised once again, failure to comply <br />as outlined above may also result in the <br />you a rental fee based upon an appraisal <br />Lands and Realty regulations. Specifically, <br />the three large structures and all contents therein, along with <br />all miscellaneous materials, refuse, and debris. However, you <br />are once again instructed not to disturb the historic wooden <br />outbuildings. You are also required to break up and bury all <br />cement foundations and to reclaim the surface to approximate pre- <br />existing contour, including the very small mining pit, and the <br />high wall just west of the facilities. All compliance items <br />listed above shall be completed to BLM standards by no later than <br />December 1, 2002. This is the last thirty-day time period <br />
