In that correspondence you were required to begin reclamation activity as detailed therein within thirty (30) days of receipt of that notification. This deadline expired on April 11, 2002. A field inspection conducted on April 15, 2002, found no evidence of any required reclamation work having been initiated. As a result, this project is hereby found to be in non-compliance with Federal Surface Management Regulations found at 93 CFR 3809, and Federal Surface Use and Occupancy Under the Mining Laws Regulations found at 43 CFR 3715. Under ~3809.601(a) a noncompliance order may be issued if your operation does not comply with any provision of your notice, plan of operations, or requirement of this subpart. This noncompliance order is being issued due to your failure to comply with requirements at X3809.924(2). Under X3809.929(2) we required that within thirty days of receipt of our previous correspondence you begin removing all structures and equipment and reclaim the project area. You have failed to begin this work as required.
