<br />October 21.1999 <br />BaFFIeMounFainGold <br />• <br />Mr. Jim Dillie <br />State of Colorado <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Re: Notice of Completion •'±~lVEC <br />San Luis Mine Project <br />Permit No. M-88-112 <br />• .'~ .e::.a n Geoio9Y <br />Deaz Mr. Dillie: <br />The purpose of this letter is to submit Battle Mountain Resources Inc.'s (BMRI) Notice of <br />Completion for use of undisturbed lands currently contained within the Colorado <br />Division of Minerals and Geology (CDMG) permit property boundary. These <br />undisturbed lands are associated with lands owned and controlled by Earth Sciences Inc. <br />(ESI) upon which no BMRI mining or beneficiation activities have been conducted. This <br />Notice is submitted as an administrative adjustment to the CDMG permit property <br />boundazies and does not constitute a request for partial or complete release of any <br />financial warranty as discussed in Sections 7.2.10 or 7.2.11 of CDMG's regulations. <br />BMRI requests that the CDMG permit property boundary be adjusted to account for a <br />recent land property transaction conducted between ESI and BMRI. This transaction will <br />transfer title to BMRI of all property previously or currently affected by BMRI mining <br />and beneficiation operations. Therefore, BMRI desires to adjust the permit property <br />boundary as shown on the attached Plat to retain within the CDMG permit property <br />boundary all BMRI related disturbances and requests release for all other lands currently <br />owned and controlled by ESI. These ESI lands are represented as those lands outside the <br />adjusted permit property boundary as shown on the attached Plat. Because there are no <br />BMRI mine-affected lands associated with those undisturbed ESI lands which BMRI <br />requests release from the existing permit property boundary, there would be no financial <br />warranty to be released. <br />Even though BMRI is not seeking any financial warranty release, BMRI will voluntarily <br />publish notice in a newspaper of general circulation in the area of the mining operation <br />for which the release is sought.
