Shelton Director RE: Webster Sand and Gravel Unpermitted Operat`~ions in Lake County NOTICE OF FORMAL PUBLIC HEARING Dear Mr. Webster: On January 28, 1981, [he Mined Land Reclamation Board moved to issue a Notice of Violation for mining without a permit and a Lease and Desist Order for your sand and gravel operation located in approximately the SWI, of the NEk and the NWT of the SE4 of Section l6, Township 9 South, Range 80 West of the 6th P. M. in Lake County. Consideration of civil penalties in [his matter were deferred until a later date. Since that time, no application fora 112 permit application for this operation has been received by this Division from Webster Sand and Gravel. On August 31, 1981, reclamation specialist James McArdle and I inspected the operation mentioned in the previous paragraph as well as another Webster Sand and Gravel operation located in approximately [he NEB of Section 20, Township 8 South, Range 80 West of [he 6th P. M. in Lake County. This operation is estimated to be about 60 acres or more in ex- tent. This second operation (like the first) has not been permitted under the Colorado Mined Land Reclamation Act. There was evidence of extensive excavation, product stockpiling and loading, and water impound- ment on the site. There was no evidence of topsoil stockpiles on the site. During the inspection of the firs[ operation (the one having a Cease and Desist Order), it was evident that stockpiled topsoil had been removed from the site. About 800 cubic yards of topsoil had been removed from a site near the southwest edge of the pit. All mining operators including sand and gravel operators are required to obtain mining and reclamation pern7its for their mining operations in Colorado by the Mined Land Reclamation Act, C.R.S. 1973, 34-32-101 et seg., and specifically, 34-32-109(7), as amended.
