179-001, Violation ~2 is issued to address the areas noted <br />above that have not been returned to approximate original <br />contour. <br />Cover depth on the refuse was determined by digging holes at <br />random using a track backhoe. Cover on the backfilled slopes <br />at the Helen portals was observed to be 4 feet. In one hole <br />in the middle of the refuse pile and two on the western end <br />the cover was observed to be only 36 to 39 inches. <br />During the inspection it was discovered that approximately two <br />acres around the shop, water tower, and concrete structures <br />was not to be considered for bond release at this time. The <br />landowner has requested that these structures be left for his <br />use. A permit revision addressing this matter is being <br />considered. <br />The stream channel diversion which was approved }as a <br />permanent structure by the Colorado Division of Minerals and <br />Geology does not appear to comply with the requirements of <br />4.05.4(4) of the Regulations of the Colorado Mined Lands <br />Reclamation Board for Coal Mining. This diversion consists of <br />a culvert which is 8 feet in diameter and approximately 750 <br />feet long covered with an estimated two to three feet of soil. <br />This culvert collapsed and was partially replaced in the past <br />and the state wrote a Notice of Violation for sediment build- <br />up in 1993. This structure appears to be a maintenance <br />liability if left in its present configuration. TDN X95-020- <br />179-001, Violation ~1 was issued to address this situation. <br />Three transformers, a fan housing and a piece of mining <br />machinery remain on the site. These items need to be removed <br />prior to Phase I bond release. <br />
