-3- <br />SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV-2006-006 <br />NATURE OF VIOLATION: <br />Failure to dispose of coal mine waste wash plant washings (underflow thickener) in accordance with <br />approved procedures of the permit. Failure to conduct surface and underground mining activities so as to <br />minimize disturbance to the prevailing hydrologic balance in the mine plan area. Failure to maintain <br />sediment pond E so as to provide adequate capacity to treat the runoff or inflow entering the pond as a <br />result of the 10-year, 24-hour precipitation event. Failure to prevent an unapproved disturbance by <br />surface coal mining and reclamation operations of land within 100 feet of an intermittent stream. Failure <br />to meet all applicable performance standazds of Rule 4. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT <br />SECTION(S) 34-33-120(1), -120(2)(j), -120(2)(x), -121(2)(c) <br />REGULATION <br />SECTION(S) 2.07.7(2), 2.07.7(3)(a), 2.07.7('x; 2.07.7(8); 4.01.1(5), 4.01.1(7), 4.01.1(9), <br />4.013(2), 4.04(2), 4.05.1(1); 4.05.1(4)(a); 4.05.2(8), 4.05.6(3)(a), 4.05.18(1), <br />4.10.1(1) <br />PERMIT <br />SECTION(S) Permit: IV.C.4.a; IV C.8; IV.C.9. Permit Application Package: pages 2.05-30; <br />2.05-129 <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />_This notice applies to the return of thickener underflow (slurry) generated at the Prep (coal wash) <br />Plant to abandoned workings located in the Eastern Mining District.. A rapture in the pipe that conveys <br />the slurry to a borehole down into the mine released the slurry into Sedimentation Pond E. Resultant <br />dischazge from Pond E flowed into Foidel Creek. As a result of this dischazge to Pond E, Pond E <br />contains coal fines to a level above design sediment storage, and coal fines (thickener) entered Foidel <br />Creek. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Step 1: Cease discharge of thickener underflow to Sedimentation Pond E. <br />Step 2: Repair the thickener underflow pipe. <br />Step 3. Perform immediate damage control activities on Foidel Creek. <br />Step 4: Notify the Colorado Division of Public Health and Safety CDPHE), the Colorado Division of <br />Wildlife (CDOW) and the U.S. Army Corps of Engineers (CE) of this event. <br />Step 5 Notify downstream water users, from the point of discharge from Sedimentation Pond E to the <br />confluence of Trout Creek with the Yampa River, of the un-permitted discharge, and demonstrate to the <br />Division such notification. <br />Step 6: Assess the discharge and receiving stream water quality (includes sampling of Sedimentation Pond E <br />dischazge, Foidel Creek and Trout Creek), contain the coal fines discharge, and assess potential toxicity <br />impacts (includes documentation of chemical constituency of the discharged material) to Foidel Creek and <br />
