In the past, Slurco has been allowed to update the records kept at the Clerk's Office on a regular basis <br />where we update the file during inspections or send a package of information containing several <br />documents. The attached letter exhibits the manner in which Slurco has completed the updates in the <br />past. However, significant documents such as the insurance certificate are updated at specific times to <br />remain in compliance. <br />In summary, Slurco feels that because certain records were not found on the day of the inspection, it does not <br />constitute a violation since there have been several inspections (the latest being by the Division on August <br />31, 1994) which indicated that the records were complete and we can document that some of the listed <br />information was either present in the past or was sent to the Clerk's Office. Slurco has chosen to utilize the <br />Clerk's Office as a repository for it's public records as the mine has been totally reclaimed since 1987 and <br />there is no office on-site. Typically, use of the Clerk's Office ensures maximum public access to the mine's <br />records. Slurco is well aware that County filing and tracking of records can result in periodic omissions from <br />the file, but historically, the Division has noted omissions, informed the company, and we have immediately <br />remedied the situation. The public records requirements are a difficult regulation for reclaimed properties <br />which are waiting out the bond liability period. The Division has historically worked with operators in our <br />situation to achieve the intent of the law. We also feel that since we do not have 1110 percent control over <br />maintenance of the file that a more appropriate procedure to handle this issue would be to request Slurco <br />submit the missing documents since all are available, rather than write a violation. <br />We would also request that we be notified (within 48 hours) of inspections so that we may participate in <br />inspections and resolve this type of issue at the site. <br />Should you have questions or if you need additional information concerning this request for vacation, please <br />do not hesitate to let me know. <br />Sincerely, <br />~` ~" <br />Jerry H.
