Box 281304 <br />LAKEWOOD, COLORADO 80228-9304 <br />Telephone: (303) 900-9340 <br />October 21, 1994 <br />RECEIVED <br />OCT 2 4 1994 <br />Mr. Mike Long, Director <br />Colorado Division of Minerals and Geology <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, CO 80203-2273 <br />Division of Minerals 8 Geology <br />RE Request for Vacation of Notice of Violation C-94-026, Canadian Strip Mine, Permit C-81.026 <br />Dear Mr. Long: <br />On September 27, 1994, Mr. David Berry (during an oversight inspection with Mr. F_dzel Pugh with OSM) <br />issued the above referenced Notice of Violation (NOV) for failure to retain copies of all required records at <br />the public record storage loption. Slurco Corporation hereby requests vacation of [he above referenced NOV <br />for the following reasons: <br />1. Slurco contends that all of the cited records have been sent to the public records storage location (Jackson <br />County Clerk's Office in Walden). In fact, evidence of two of the alleged missing documents can be <br />verified. The insurance certificate was sent as it was received from the insurance company (see attached <br />submittal). The attached OSM inspection report also references the permit document with its renewed <br />date. <br />2. The Division inspects these records on a quarterly basis and the OSM inspects the records on an annual <br />oversight basis. The following information indicates some of the dates of inspections where the records <br />were deemed complete: <br />Date of Inspection Apencv Performine Inspection Deficiencies Cited <br />August 31, 1994 Division None <br />February 1, 1994 Division and OSM None <br />August 19, 1993 Division None <br />June 8, 1993 Division None <br />March 30, 1993 Division and OSM None <br />3. As records are sent to the Clerk's Office, we depend upon them to place the information in the <br />appropriate file. Some confusion may have taken place with the name change from Wyoming Fuel <br />Company to Slurco and the information may have gotten filed fn the wrong place. In fact, an occasion <br />has been cited where Slurco information has been observed in one of the other mine's information file. <br />4. The County Clerk's Office is a public building which has free access. This includes members of the public, <br />County Clerk staff, Division and OSM inspectors, a number of mining companies, etc. As a result, there <br />is a high probability that as information is filed or reviewed, it is misplaced. Slurco does inspect the files <br />and attempts to keep all required information in the file, however, we can not be sure that we are always <br />in compliance due to the manner in which the records kept. <br />
