Prior to the inspection, the super-curve azea was inspected as part of the Road, Ditch & <br />Culvert Maintenance Schedule process described in Section 3.5.4 of the permit application. <br />This area was initially scheduled to receive maintenance on May21-22. However, <br />continual inclement weather precluded the completion of the maintenance prior to the <br />inspection. As noted in the inspection report, Part IV. Enforcement Actions, a temporary <br />ditch to transport all drainage water from the road ditches to the ditch on the south side of <br />the road was installed prior to the completion of the inspection. <br />North End of Mofjt Pond <br />2a. Clean out sediment from north end ojMoffat Pond and the outlets ojNorth Diversion Ditch <br />and Final Moffat Drainage Channel; (abatement required - 18 July 1997) <br />b. repair riprap and liner in Final Moffat Channel; (abatement required - 18 July 1997) <br />c. spray thistle that has grown up on sediment deposited in undisturbed areas affected by <br />Moffat Pond short-circuit; (abatement required - 11 July 1997) <br />d seed the gullies in undisturbed area but do not regrade or further disturb the native <br />vegetation. (abatement required - 18 September 1997) <br />P&M concurs with the Division's observation that the circumstances resulting in the short <br />circuiting of the Moffat pond is uncertain. However, P&M does not believe the sediment at <br />the north end of the Moffat pond and the outlets of the North Diversion Ditch and Final <br />Moffat Drainage Channel contributed to the short-circuiting of the Moffat pond. The <br />accumulation of sediment at those locations is insufficient to cause or contribute to the <br />overflowing of the North Ditclr. P&M has observed that [he west side of the North Ditch <br />is lower in elevation than the emergency spillway. Therefore, in addition to cleaning out <br />the sediment required by the Division, P&M will raise the west bank of the North Ditch to <br />ensure the pond does not short-circuit in the future. <br />Moffat Area Reclamation <br />3a. Repair erosion damage (gullies) with reclaimed portions of Moffat Area according to <br />Permit section 4.3 (abatement required - 18 July 1997) <br />b. spr~v thistle shat has grown up on sediment deposited in undisturbed areas from erosion of <br />reclaimed urea; (abatement required - Il July 1997) <br />c. seed t1:e gullies in undisturbed area but do not regrade or further disturb the native <br />vegetation; (18 September 1997) <br />The individual features noted during the inspection have already been inventoried in <br />accordance with the Erosion Control Plan, Section 4.3.6 of the permit application. The <br />gullies were repaired by June 25,1997. The erosion control plan requires a report <br />concerning such erosion damage to be submitted to the Division by July I5, 1997. The <br />report was submitted on July 1, 1997. <br />Spraying of thistle and weeds in general at the Mine was previously contemplated. Contact <br />with a contractor to perform the task was initiated on June 9, with a field inspection of the <br />mine on the morning of June 20.
