PAGE THREE <br />CASE #PRJ2001-00060 <br />STAGECOACH SAND & GRAVEL MINE <br />The new lot and rezoning would comply with the Adams Count~Subdivision Regulations in <br />that it would have adequate access off of Brighton Road and East 1241h Avenue. This parcel <br />would be large enough for development, when development is proposed. At such time, the <br />property will be required to gain permits from the Division of Water Resources for well <br />permits and from Tri-County Health Department for any sanitation permits. Currently, the <br />applicants have no plans for development on this site. The site currently has legal access onto <br />Brighton Road, which the applicant plans to move north to increase the distance from 124'h <br />Avenue. Overall, the proposed subdivision is able to comply with the requirements of the <br />Adams Counri Subdivision Regulations. The minimum lot size in the A-] Zone District is <br />2.5 acres, with individual wells and septic systems. The proposed new lot will meet this <br />requirement. The minimum lot size in the A-2 zone district is 10 acres. The balance of the <br />property will exceed this requirement. P.s long as all conditions and stipulations are adhered <br />to, this application will comply with all requirements of the Adams Count~Zoning <br />Regulations. <br />2. The Adams County Comprehensive Plan identifies this property and surrounding area as <br />Agriculture, Parks and Open Space, as well as Natural Resource Conservation. This <br />proposed Rezoning of the 2.5-acre parcel would comply with the Adams County Zoning <br />Re ttlations and the Adams County Comprehensive Plan in that the rezoning would be <br />consistent with the area. Since most of the parcel being mined is within the Floodplain, no <br />other development would be permitted without Floodplain Use Permits and approval from <br />Urban Drainage and Flood Control District. After the larger parcel is mined, the ultimate use <br />of the land would be open space, which would be consistent with the intent of the Adams <br />Counri Comprehensive Plan, <br />Overall, the proposed subdivision and rezoning of the smaller parcel would not have an <br />adverse effect on the health, safety, or general welfare of the inhabitants of the area or the <br />County. This rezoning would maintain the current character of the area. As long as the <br />stipulations are strictly adhered to, the sand and gravel mine would not be detrimental to the <br />health, safety, or welfare of the inhabitants of the area and the County. The final phase of this <br />project would be the reclamation of the site and would be open space and water reservoir. <br />This would be harmonious with the character of the neighborhood and the surrounding area. <br />Conditions Precedent: <br />The applicant shall submit a final mylar of the subdivision, depicting the conservation <br />easement, as requested by the Adams County Parks Department. <br />2. The applicant shall submit Public Land Dedication in the amount of $497.25 to the <br />Adams County Planning Department. <br />Stipulations: <br />The Conditional Use Permit shall be granted to Lafazge, and shall be nontransferable to <br />any other party except by amendment to the Conditional Use Permit. <br />2. The Conditional Use Permit shall expire on March 18, 2007. <br />
