COOLEY RESERVOIR AND FULTON WILDLIFE AREA PIT <br />AMENDMENT NO. 1 - JERONIlVIUS PROPERTY <br />EXHIBIT D -MINING PLAN (Continued) <br />Method of mining to be employed is surface excavation of topsoil, overburden, and aggregate <br />material for use in the production aggregate products. Equipment that will be used on site include a <br />drag-line, loaders, scrapers, backhoes, dozers, excavators, water trucks, end dump and belly dump <br />trucks, and other miscellaneous vehicles. Field conveyors, hoppers, and transfer points will be utilized <br />to provide conveyance to the Plant Site, and piping will be installed to convey wash water back to <br />the lake areas from the Plant Site. No explosives will be utilized in the operation. <br />Except as outlined below and in accordance with standards established in the existing permit, the <br />minimum excavation setback shall be 35' from any adjacent property line. As with the existing phases, <br />slopes may be initially excavated to a nearly vertical condition, .SH to 1 V, but afterward will be <br />backfilled to at least 1H;1 V slope for areas that are to be filled with sand spoils and silt water. All <br />final slopes of permanent Take area shall be minimum of 3H to I V in steepness. Typical excavation <br />and final reclamation sloping and minimum setbacks are shown graphically on EXHIBIT F- <br />RECLAMATION PLAN MAP. Situations where special setback requirements and restrictions on <br />excavation shall apply are as follows: <br />l . The existing wetlands area as shown on EXHIBIT C-2 -MINING PLAN MAP shall not be <br />disturbed until a wetland inventory is accepted by the Corp of Engineers and a 404 permit is <br />issued allowing removal of anyjurisdictional permit requiring the appropriate 404 permit. <br />2. No mining shall occur within the Xcel right-of--way, nor shall any mining be undertaken <br />within 200' of the Xcel. towers, without mutual execution of a written license agreement <br />between AI and Xcel. <br />3. No mining shall occur within 290' of East 104'h Avenue without consent and a written <br />agreement by CDOT. <br />4. Per conditions of the existing permit, no mining shall occur within 65' of the inside top east <br />high bank of the Fulton Ditch without a written agreement from the Fulton Ditch Company <br />on a setback of less than 65'. <br />Prior to installation of the conveyor and pipe crossing across the Fulton Ditch, an agreement with <br />the Fulton Imgating Ditch Company will be obtained. This agreement, and any other agreement for <br />a lesser setback in any of the above situations, shall be submitted to the DMG, prior to any excavation <br />being undertaken in any special setback area. Prior to any excavation being undertaken in any area, <br />excavation setbacks will be staked in the field to ensure relevant excavation setbacks are followed. <br />
